Protecting customer data and using it only as our customers expect and in accordance with applicable law is our highest priority. The following privacy notice is intended to inform you about the processing of your personal data when using our website and all functions available on this website, as well as your rights in relation to this processing, in accordance with the EU General Data Protection Regulation (GDPR) and other applicable data protection regulations.

2.Processing of Your Personal Data When Visiting Our Website
a. Accessing the Website gsgastro.de and All Subpages
When using our website, the following (personal) data is automatically collected via your device (computer, mobile phone, tablet, etc.) and temporarily stored as log files without your intervention:
• The currently used IP address of your device
• Date and time of access
• Name and URL of the retrieved file
• Browser type and operating system of your device
• Website/application from which the access occurred (Referrer URL)
• Name of the access provider.
This data is processed for the following purposes:
• Data security
• Evaluation of system security and stability
• Optimization of our offerings
• Improvement of our website.
The processing of your IP address is based on Art. 6 para. 1 sentence 1 lit. f) GDPR. Our legitimate interest lies in the purposes of data processing listed above.
b. Customer Surveys
When participating in our online customer surveys, no information is stored that allows conclusions to be drawn about your participation in the survey. We ask you to refrain from entering names or similar details in the free-text fields that could identify you or other individuals. In case you provide consent when participating in a customer survey, you can withdraw this consent at any time with effect for the future. Details can be found in the supplementary privacy notices of the respective customer survey. If you provide a consent declaration in the context of a customer survey, Article 6 para. 1 sentence 1 lit. a) GDPR is the legal basis for data processing based on consent.
c. Use of Cookies
We use cookies and similar technologies on our websites to provide you with an optimal online experience. Information about the use of cookies and tracking tools can be found on our cookie page.
d. Integration of Google Maps
We use Google Maps (API) on our website, provided by Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
This allows us to display interactive maps directly on our website and enable you to use the map feature, such as finding GS Gastro GmbH. When accessing the subpages where Google Maps is embedded, information about your use of our website (e.g., your IP address) is transmitted to Google's servers and stored there; this may also involve transmission to servers of Google LLC in the USA.

3. Registration-required Services
a. Customer Retention and Advertising/Newsletter Subscription
General Use of Data for Advertising Purposes
In addition to the personal data you provided during your authorized shopper registration, we collect and process (personal) data obtained through customer contact (e.g., when responding to customer inquiries) and during the purchases of GS Gastro GmbH customers and authorized shoppers, such as information about the type and quantity of products you purchased, the purchase price, the location and time of the purchase, participation in sweepstakes, redemption of vouchers, and other personal data you provide as part of the contractual relationship.
We process this information, among other things, for customer retention purposes. This includes market research and marketing, customer satisfaction surveys, analysis of customer behavior, and customer segmentation to forecast future customer behavior, such as potential customer churn, shopping habits, and shopping times. For the purposes mentioned above, your personal data is stored in our systems and enriched with data from publicly available sources (e.g., phone directories or publicly available internet sources). The processing of your personal data for these purposes is based on Art. 6 (1) Sentence 1 (f) GDPR. Our legitimate interest lies in improving our services and the customer relationship with you in a sustainable way. The personal data we process and store helps us learn more about your interests and needs. This allows us to tailor our offerings to your interests.
We also process the above-mentioned data to send you personalized advertising content (scope detailed below) by mail and/or phone and/or to visit you for these purposes at your business. The processing of your personal data for these purposes is based on Art. 6 (1) Sentence 1 (f) GDPR. It is in our legitimate interest to inform you about certain offers and services, personalize them, and thus build the customer relationship with you.
Email Newsletter
You can subscribe to our newsletter, for example, via the newsletter form. If you provide us with your personal data (email address) for this purpose, you will receive an email from us. To complete the newsletter registration, you click on the confirmation link in this email.
For proof purposes, we store the IP address and the time of registration or confirmation. This is based on our legitimate interest in accordance with Art. 6 (1) Sentence 1 (f) GDPR.
Our newsletter is exclusively aimed at GS Gastro GmbH customers. Therefore, we automatically check whether the email address entered in the newsletter form is already stored in our customer data. This is based on our legitimate interest in optimizing the user experience according to Art. 6 (1) Sentence 1 (f) GDPR.
We analyze your user behavior as follows: Each newsletter contains so-called tracking pixels. For the evaluations, we link these with your email address, the data collected by the newsletter tool (see the next paragraph), and a unique ID. The links in the newsletter also contain this ID. This allows us to track when you read our newsletter and which links you open. This helps us evaluate the reach of our newsletters and optimize their content.
Our newsletter tool stores the following data: recipient's email address, operating system of the device, including version number (e.g., "Android 13"), browser (e.g., "Edge"/"Firefox"), opened links, timestamp of clicks and opens, opened messages, IP address from Double-Opt-In clicks (to prove the Double-Opt-In), delivery errors (e.g., "email address unknown" or "mailbox full") (for each delivery error, the error message (bounce email) is stored for 30 days; after 30 days, only the timestamp and error type are kept (permanent or temporary error)). The above-mentioned data is only collected after you have actively consented, i.e., only after you confirm your consent in the Double-Opt-In process.
We store data related to your user behavior only until you unsubscribe from the newsletter. You can, for example, click the "Unsubscribe" link in any newsletter. Afterward, we will immediately delete your related data. If you are a GS Gastro GmbH customer, this will not affect your customer status. However, please note that after unsubscribing, you will no longer receive vouchers and personalized offers from us. For more information on withdrawing your consent, please see the "Your Rights" section below.
The processing for sending the newsletter and analyzing your user behavior is based on Art. 6 (1) Sentence 1 (a) GDPR.
Facebook
To inform you about our products on Facebook, we use so-called Prospect Audiences. These are created by us in compliance with data protection regulations. We pseudonymize all data of affected individuals and act as a "Trusted Third Party" when placing advertisements on Facebook, i.e., as a "neutral matching partner." As part of this procedure, we transmit personal data of our customers (at least names and postal addresses) based on a data processing agreement in accordance with Art. 28 GDPR. Due to technical and legal measures taken, including the conclusion of a data processing agreement between Facebook and us in accordance with Art. 28 GDPR, it is excluded that the pseudonymization of customer data is lifted by Facebook. Legal basis: The processing of your personal data is based on Art. 6 (1) Sentence 1 (f) GDPR. Our legitimate interest lies in presenting our products to you through targeted advertising on Facebook, as long as you allow Facebook to display targeted ads in your ad settings.
We are jointly responsible with Facebook for the processing of your data on Facebook, as we determine which anonymized data Facebook collects to display interest-based ads, including ours. You can exercise the rights listed in the "Your Rights" section with us. To assert your rights with Facebook, please contact Facebook directly. Google
To also inform you about our products and services on Google, we use the data in compliance with data protection regulations on Google. 4. Contact Form and Customer Inquiries
You have various ways to contact us, such as via email, contact form, mail, or phone. When you contact us, we use the personal data you voluntarily provide solely for the purpose of reaching out to you and processing your inquiry. The legal basis for this data processing is Article 6(1) Sentence 1 lit. b) GDPR, as well as Article 6(1) Sentence 1 lit. f) GDPR. Our legitimate interest lies in the goal of answering your inquiries and thus maintaining and promoting your satisfaction as a customer or user of our website.

5. Social Media Channels

6. Recipients of Personal Data
To achieve the above-mentioned purposes, we use service providers. These may include both external service providers and recipients, as well as freelancers. If we engage service providers as data processors, they only have access to your data to the extent and for the duration necessary to provide the respective service.
We pass your personal data to our IT service provider when you visit our website or use our online services. Additionally, when you register as a customer, we share this data with the operator of our customer databases.
Your personal data is also transferred to the following recipients:

For the design and improvement of our online offerings: customer number, revenue within a specified period.

To fulfill reporting obligations, security checks on our behalf, as well as for the creation and evaluation of statistics on our behalf: all customer data, including all purchase data.

Logistics service providers such as MBL Logistics GmbH, Saarbrücken, for processing orders from delivery customers: customer master data, shipping data, delivery address, and name and contact details of a contact person to ensure they are available to receive the delivery.
The following recipients receive your personal data, and they are bound by our instructions as data processors: -
Printing service providers for the printing of mail and brochures: company name, recipient’s first and last name, and address.

Email delivery services such as Outlook for sending newsletters and email marketing, if you have consented to receive them: recipient's first and last name, email address, and an ID for tracking purposes.

The following service providers receive your personal data to fulfill a service contract with us or to provide a service you requested: -
Postal services for sending mail and brochures: company name, recipient’s first and last name, and address.

Legal service providers in case of legal disputes: customer master data, financial data, and other data necessary to process and settle the legal dispute.

Banks for processing transfers.
Some recipients may be located both within and outside the European Union or the European Economic Area. We ensure through contractual agreements with service providers that they process personal data in compliance with the GDPR, even if the data processing occurs outside the European Union or the European Economic Area in countries where an adequate level of data protection is not otherwise ensured and where there is no adequacy decision from the European Commission. For more information on the existence of an adequacy decision by the European Commission and on appropriate safeguards, or to obtain a copy of these safeguards, you can contact our data protection officer at gs-gastro@outlook.de.
Furthermore, we only transmit data to authorities and other third parties (e.g., tax offices) if there is a legal obligation to do so. In this case, the transmission is based on Art. 6 para. 1 sentence 1 lit. c) GDPR. -

7. Retention Period

We generally store your personal data for as long as it is necessary for the stated purposes, especially for fulfilling our contractual obligations. However, we may need to retain your data until the expiration of retention obligations and periods set by law, which may arise from the Commercial Code and/or the Fiscal Code, and typically last 6 to 10 years. Additionally, we may retain your data until the expiration of statutory limitation periods (usually 3 years, but in certain cases up to 30 years), insofar as this is necessary for the assertion, exercise, or defense of legal claims. After that, the corresponding data will be deleted.

In addition, for the data collected during the newsletter registration: Your personal data will only be stored as long as you remain subscribed to the newsletter. If you unsubscribe, for example, by clicking the "Unsubscribe" link found in every newsletter we send, your personal data used for the newsletter distribution will be immediately deleted. However, information regarding your consent will be retained for 3 years after the withdrawal of your consent for documentation purposes.

8. Data Security
We have implemented appropriate technical measures to ensure that your data is protected against unauthorized disclosure, unlawful use, alteration, and destruction. Employees of GS Gastro GmbH are required to comply with data protection regulations when handling (personal) data.

As a data subject, you can contact our Data Protection Officer at any time with an informal message using the contact details mentioned above under 1. c) to exercise your rights under the GDPR. These rights are as follows:
• The right to obtain information about the data processing and a copy of the processed data (Right of access, Art. 15 GDPR);
• The right to request the correction of inaccurate data or the completion of incomplete data (Right to rectification, Art. 16 GDPR);
• The right to request the deletion of personal data, and if the personal data has been made public, to inform other controllers about the deletion request (Right to erasure, Art. 17 GDPR);
• The right to request the restriction of data processing (Right to restriction of processing, Art. 18 GDPR);
• The right to receive the personal data concerning you in a structured, commonly used, and machine-readable format and to request the transmission of these data to another controller (Right to data portability, Art. 20 GDPR);
• The right to withdraw consent at any time, to stop data processing based on your consent. The withdrawal does not affect the lawfulness of processing based on the consent before the withdrawal (Right to withdraw, Art. 7 GDPR);
• The right to lodge a complaint with a supervisory authority if you believe that the data processing violates the GDPR (Right to lodge a complaint with a supervisory authority, Art. 77 GDPR).
